Job Information

The Patent Counsel position will be responsible for a wide range of matters related to patent portfolio development and management. Patent Counsel will work with engineering personnel to understand the Company's products, determine what patent services need to be provided for given projects, and provide those services in cooperation with internal and external resources. This position potentially offers a hybrid work arrangement with flexibility to split time between the office and home.

Role & Responsibility

To assist with all areas of patented related work for the company. Must possess ability to work with engineering teams to understand their patent related needs and to spot potential patent related issues. Must possess ability to communicate patent related issues clearly and simply to personnel that are not trained patent professionals.

Legal Matters

  • Work on a variety of patent related matters, including:
  • Work with engineering personnel to assess new designs for potential patentability and clearance issues.
  • Manage patent application preparation. Engage engineering personnel and outside counsel to manage disclosure of inventions and filing strategy with consideration of our existing portfolio and patent protection needs. Assist outside counsel with preparation of patent applications.
  • Manage US and foreign prosecution of Bobcat's patent portfolio.
  • Assist in various portfolio management activities, including patent marking, patent portfolio review and maintenance fee/annuity decisions, etc.
  • Assist with patent landscape searches and competitive chokepoint analyses.
  • Assist with review of intellectual property clauses in various transactional agreements.
Cross Team Integration
  • Work collaboratively with internal clients in North America and Europe on patent related matters.
  • Participate in company-wide initiatives and other discrete projects as needed.

Job Requirement

  • Education Required: Law - Juris Doctor.
  • Experience: 6-9 years of experience as a practicing patent attorney involved in the preparation and prosecution of US patent applications.
  • Travel Required: 25%.
  • Licensed attorney in at least one state.
  • Registered U.S. Patent Attorney.
  • Preferred areas of patent preparation experience include engines, motors, electrical systems, vehicle control and hydraulics.
  • Technical background related to electrical or mechanical engineering with an undergraduate or advanced degree in electrical or mechanical engineering.
  • Experience managing foreign patent prosecution preferred.
  • Industry experience as a practicing engineer a plus.
  • In-house patent counsel experience a plus.
  • Ability to interact effectively with all levels of the organization.
